AND CONDITIONS. IF YOU DO NOT AGREE WITH THEM, YOU SHOULD
PROMPTLY RETURN THE PACKAGE UNOPENED TOGETHER WITH THE
WRITTEN MATERIAL, WHICH ARE PART OF THIS PRODUCT, TO THE
PLACE WHERE YOU OBTAINED THEM FOR REFUND. USE OF THIS
PROGRAM INDICATES YOUR ACCEPTANCE OF THE TERMS AND
CONDITIONS.
Optware provides this program and licenses its
non-exclusive use. Your use of the program acknowledges
that you have read this agreement, understand it and
agree to be bound by its terms and conditions.
LICENSE
You may use this software on a single computer, but
may transfer it to another computer as long as it is used
on only one computer at a time. You may make one (1) copy
of the software for backup purposes only. You may not
distribute copies of this software or accompanying
written material to others. You may not modify, adapt,
translate, reverse engineer, decompile, dissasemble or
create derivative works based on this software or
accompanying written materials without the prior written
consent of Optware.
YOU MAY NOT USE, COPY, MODIFY, TRANSFER, ASSIGN, RENT,
LEASE, SELL OR OTHERWISE DISPOSE OF THE SOFTWARE, IN
WHOLE OR IN PART, EXCEPT AS EXPRESSLY PROVIDED FOR IN
THIS LICENSE.
This licence is effective until terminated. You may
terminate it at any time by destroying the software
together with all copies, modifications and merged
portions in any form. The licence also terminates if you
fail to comply with the terms and conditions of this
agreement.
This software and accompanying documentation are
protected by Swiss Copyright law and also by
International Treaty provisions. Any use of the software
in violation of these laws constitutes termination of the
licence and can be prosecuted.
LIMITED WARRANTY
Optware warrants that the diskettes on which this
software is furnished to be free from defects in
materials and workmanship for a period of 90 days
from the date of delivery to you.
Optware does not warrant that the functions contained in
this software will meet your requirements or that the
software operation will be uninterrupted or error free.
Optware’s entire liability and your exclusive remedy
shall be the replacement of any diskette not meeting
Optware’s "Limited Warranty" and which is
returned to Optware within the warranty period with a
copy of your receipt or other proof of payment.
IN NO EVENT WILL OPTWARE BE LIABLE TO YOU FOR ANY
DAMAGES, INCLUDING ANY LOST PROFITS, LOST SAVINGS OR
OTHER INCIDENTAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF
THE USE OR INABILITY TO USE THIS PROGRAM, OR FOR ANY
CLAIM BY ANY OTHER PARTY.
UPDATE POLICY
Optware may create, from time to time, updated versions
of this software. At its option, Optware will make such
updates available to you, if you have paid the update
fees and returned the Registration Card to Optware.
GENERAL
This agreement shall be construed, interpreted and
governed by the laws of Switzerland. You agree that this
is the complete and exclusive statement of this agreement
which supersedes any prior agreement or other
communication between us on this subject. The exclusive
legal venue for disputes which cannot be resolved out of
court, shall be Lausanne, Switzerland, but Optware may
choose to sue any infringement of the terms of this
Licence Agreement at its choice at the competent legal
venue of the infringer.
